Right of withdrawal and return policy
You can exercise your right of return by either other of the following methods, in accordance with article L.221-24 of the French Consumer Code.
a) Without prejudice to the return of items directly to an Isabel Marant boutique listed on the www. isabelmarant.com, online submission to the seller of the Returns Form appearing in the section Customer Service
b) Sending to the Seller the form - to be completed in its entirety - downloaded from the website www.isabelmarant.com* and conforms to the model, in accordance with article L. 221-5 2° and the appendix to article R.221-1 of the French Consumer Code.
In cases b) and c), your declaration must be addressed to the Service customers, at the registered office of YOOX NET-A-PORTER GROUP S.p.A., via Morimondo, 17 – Milano 20143. In these cases, you will be responsible for proving that you have duly exercised your right to withdraw from the sales contract within the prescribed period.
In accordance with article L.221-23 of the French Consumer Code, once you have exercised your right of withdrawal from the sales contract, the products to be returned must nt be entrusted to a carrier within fourteen (14) days from the date on which you notified the Seller of your decision to withdraw or, if you decide to return the products by going directly to an Isabel Marant store indicated on www.isabelmarant.com, they must be delivered to the sales staff within fourteen (14) days from the date on which the products were received.
In accordance with the Article L.221-28 of the French Consumer Code, the right of return is excluded if you have purchased personalized products or in the case of sealed items which have been opened after delivery and which cannot be returned for health or hygiene reasons.
1. CONDITIONS FOR EXERCISE OF THE RIGHT OF WITHDRAWAL IN ACCORDANCE WITH ARTICLE L.121-20-12 OF THE FRENCH CONSUMER CODE
The right of withdrawal from the sales contract will be deemed to have been duly exercised if all the following conditions are met:
- The right of withdrawal has been duly exercised within fourteen (14) days of receipt of the products by following the aforementioned procedures or, if the "Collection in store" option (if applicable) has been selected at the time of purchase, from the date you collect the products from the Isabel Marant store.
- the products must not have been used, worn or washed and, in any case, they must comply with the requirements indicated in art. 3 which follows on the conformity checks of returned products.
- The identification tag with the disposable seal is always attached to the products, of which it is an integral part.
- The products are returned in their original packaging
- The products are entrusted to the carrier within fourteen (14) days from the date on which you notified the Seller of your decision to withdraw or, if you decide to return the products by going directly to a Isabel Marant boutique indicated on www.isabelmarant.com, they must be given to the sales staff within a period of (14) days from the date on which the products were received. - Due to government health measures related to Covid 19, in-store services may not be available. - The products are not damaged.
If you meet the applicable conditions, the Seller, in accordance with article L.221-24 of the French Consumer Code, will refund you the full price of the products purchased. The only costs payable by you will be the costs of returning the products, unless the Seller has expressly exempted you from this at the time of your purchase and on the condition that you use the carrier and the shipping methods referred to above. later in section 2.
2. PROCEDURE FOR RETURNING PRODUCTS TO THE SELLER - UPS
The Seller recommends that you use the carrier UPS (www.ups.com) to return products. If you use UPS and the pre-printed label – which bears the return address – included in the original order, you do not have to pay the return costs. The Seller will pay the UPS service on your behalf and deduct from your reimbursement the amount of the costs incurred to deliver the purchased products to you. Contact UPS to arrange the return . The possibility of tracking a package sent by this shipping service at any time exempts you from any liability in the event of loss or damage to the products during their transport. If you choose to return products with a carrier other than UPS, you must pay the return shipping costs and are responsible for any loss or damage to the products during shipment. In this case, you will also be reimbursed an amount equal to the standard shipping costs of the products purchased but, in accordance with article L.221-24 of the French Consumer Code, any additional costs incurred on the grounds that you have chosen a different or faster shipping and delivery method instead of the standard method will not be refunded.
You can also return the products by bringing them to one of the Isabel Marant boutiques listed on www.isabelmarant .com. You won't have to wait to send them back from home, you won't have any costs and you won't need to fill out the online return form. All you have to do is present the products and their original packaging, the pre-printed label and the order summary that was contained in the package to the sales staff of the Isabel Marant boutique within fourteen (14) days from from the date of receipt of the products. Sales staff will package the items for return to the Seller. The sales staff may simply remove the products and pack them but will not check that they comply with the conditions indicated in the General Conditions of Sale. The delivery of the products to the sales staff is therefore not equivalent to the acceptance of the return by the Seller, who will check that the return complies with the conditions indicated in the General Conditions of Sale as soon as the products have been delivered to the warehouse. He will then contact you by e-mail to tell you whether the return has been accepted or not.Without prejudice to the above, in the event that the return has been accepted, and if you have paid for your order in cash on delivery and wish to receive the refund directly on your current account, you will have to provide your IBAN to the sales staff in order to that the latter enters it in your personal information
If you choose a carrier other than that provided by Isabel Marant or for another shipping method, you will have to pay the return costs to advance in accordance with our return instructions. You will be responsible for any loss or damage to the products during transit. Except as set forth herein, you will not incur any fees arising from your claim for reimbursement. For your safety, we recommend that you use a transport service if you do not wish to use our prepaid system and authorized transport service to return your products.
3. RETURNED GOODS COMPLIANCE CHECKS
If the returned products cannot be accepted on the grounds that the conditions indicated in letters a) and e) of paragraph 1 are not met or in the event that one of the hypotheses indicated in article L.221 -28 of the French Consumer Code is verified, you will be notified. You can then choose to have the products returned to you at your expense. If you refuse this delivery, the Seller reserves the right to retain the products and the sum paid for their purchase.
All products must be returned new and must not have been used. They must be in perfect condition and provided with their protective packaging as well as their identification labels and stickers (if present), their container and any other accessories or documentation. If the product shows signs of wear or has been used or altered in any way from its original condition, the Seller reserves the right to refuse the return or, therefore, reduce the value of the refund or exchange.
For example, the Seller may reduce the value of the refund in the following cases:
- the products have been used, worn, damaged or washed;
- the identification tag is no longer attached to the products with the disposable seal or it has not been returned. Please note that the disposable seal is an integral part of each product; and/or
- the original packaging (for example, the protective bag), which is an integral part of the product, has not been returned;
If the Seller decides to reduce the refund amount for these reasons, you will be notified. In this case, you can choose, rather than obtaining a partial refund, to have the products purchased returned to you at your expense.
In the latter case, if you refuse to return the products, the Seller will have the right to keep the products as well as the value of the refund reduction, due to the decrease in value of the returned products.
4. RETURN TIMES AND PROCEDURES
Once the Seller has received the returned products and verified that all conditions have been met, you will receive an email confirming that your return has been accepted and that YNAP will issue a full refund or, if the products have lost value, you will receive an email notifying you of the amount deducted from the refund and that YNAP will issue a partial refund.Regardless of the method of payment used, the Seller will process the refund as soon as possible and, in any case, within fourteen (14) days from the date on which it became aware of your decision to exercise your right of withdrawal and once he has ensured that the return has been made in accordance with the aforementioned conditions
The time limit for refunding the amount paid for the purchase of the returned products depends on the method of payment used.
- Credit/Debit Card Purchase: Refund time will vary depending on card issuer, but will normally be within two billing cycles. The value date of the credit will be the same as the original debit. You will therefore not suffer any loss in terms of bank interest.
- Payment by PayPal: refunds will be credited to your PayPal account and will be visible immediately. The actual refund to the credit card associated with your PayPal account will depend on the company that issued the card.
- Cash on delivery (if applicable): we will make the refund to the bank account you have given us, so the refund time will depend on the accuracy of the information you have given us; reimbursement will generally take fourteen (14) days.
5. ITEMS RETURNED AS DAMAGED, DEFECTIVE OR INCORRECT
Without prejudice to the application of any mandatory consumer protection provisions, if you are returning a product due to an error on our part or on the grounds that it is damaged or defective, please notify the seller at by means of the Returns Form appearing on the Website within thirty (30) days of its receipt; if a product becomes defective after this thirty (30) day period, please contact Customer Service for further information. To return products, please refer to sections 1 and 2 above.
The Seller will examine all products so returned and notify you by e-mail of their refund within a reasonable period of time. Subject to Seller's acceptance of damaged or defective products, products which you return because they are damaged or defective will be fully refunded, including the cost of shipping the item to your address and the costs that you have incurred to return the item to the Seller. If the Seller finds no defect in the returned products, you will be advised that the returned products cannot be accepted and you can choose to have the products redelivered to you. If you do not accept redelivery, the Seller reserves the right to retain the products and their purchase price and to charge you the costs and commissions of the Seller.
6. PRODUCT EXCHANGE
In certain circumstances detailed below, you have the right to exchange your product for a product of the same model but of a different size or color. Exchanges are made subject to the availability of the products in our warehouses. You can request an exchange using the Returns Form on our website, which allows you to exchange your purchased products according to the available options.
A product exchange request is subject to the following conditions:
- A product exchange only applies to products purchased for which this possibility is expressly specified on the Returns Form appearing on our site Internet by mentioning the word “EXCHANGE”.
- You can only request the replacement of one or more purchased product(s) with products of the same model, but of a different size and/or color. The available replacement options are indicated in the
Return form online. - You may request to exchange one or more product(s) purchased no later than fourteen (14) calendar days from the date on which you received the products, by completing the Return Form and sending it electronically to YNAP within the same time frame. Products to be replaced must be returned within fourteen (14) calendar days from the date you notify Seller of your intention to exchange the products.
- You can only submit one exchange request for each product purchased.
- The products to be replaced must be returned to the Seller in their original packaging, must not have been used, washed or modified, must not be worn or damaged and must bear their identification label with the disposable seal.
- The products to be exchanged under the same order must be returned to the Seller in a single shipment. The Seller reserves the right to refuse products from the same order that are shipped for exchange in several stages.
If all the above conditions are met, once you have completed and submitted the Returns Form specifying your exchange request, the Seller will process this request by sending you a confirmation email.
Once the products to be exchanged have been received, the Seller will inspect the products to ensure that all the above conditions are met, then check the availability of replacement products in its warehouses to ensure that the size and/or color you have selected is available.
If the replacement products selected are not available in our warehouses, the Seller will not be able to accept your request for exchange and will refund you the original price of the products purchased, in accordance with the applicable legislation in terms of consumer protection and according to the procedures specified above.
If the replacement products selected are available in our s warehouses, the Seller will accept your exchange request and send you an e-mail confirming the shipment of the replacement products. The shipment will take place within thirty (30) days from the date on which the Seller became aware of your exchange request. Shipping costs for replacement products will be borne by the Seller.
When exchanging a product, if the price of the product purchased is lower or higher than the price of the replacement product chosen, you will not not have to pay the difference and will not be entitled to a refund. However, if you choose to return the exchanged product in accordance with your legal rights, you will be fully refunded the price paid for the product.
You will be contacted by the Seller if your exchange request cannot be be accepted on the grounds that the above conditions are not met. In this case, you can return the original products at your expense or the Seller will issue a refund in accordance with the procedures specified above.
Exchanged products are subject to a subsequent product return procedure, in accordance with the applicable legislation in terms of consumer protection.
7.IDENTIFICATION LABEL
We remind you that all products sold by the Seller have an identification label with a disposable seal which is an integral part of the product. Please try the products without removing this label or the seal. Products returned without a tag or seal will not be accepted.
8. CONSUMER CODE
Without prejudice to the application of the mandatory provisions specified by the EU in terms of consumer protection, these conditions for the exercise of the right of withdrawal from the sales contract form an integral part of the General Conditions of Sale and are governed by French law, in particular by the Consumer Code.
